Announcement of Decision Regarding the Disciplinary Recommendation Relating to the Shooting of Quintonio LeGrier and Bettie Jones

Police Board Member Eva-Dina Delgado made the following announcement at the April 19, 2018, public meeting of the Police Board:

Pursuant to Section 2-78-130 of the Municipal Code of Chicago, I considered one matter on which the Chief Administrator of the Civilian Office of Police Accountability and the Superintendent of Police did not agree regarding the discipline of a police officer.

Request for Review number 18 RR 03 involves allegations that Police Officer Robert Rialmo shot Quintonio LeGrier and Bettie Jones without justification.

The Chief Administrator recommended sustaining the allegations and discharging Officer Rialmo from the Chicago Police Department. The Superintendent recommended classifying the allegations as Exonerated.

After reviewing this matter, I find that the objections raised in the response of the Superintendent of Police are not sufficient to meet the burden of overcoming the Chief Administrator’s recommendation for discipline. Based on the facts and circumstances of this matter, an evidentiary hearing before the Police Board is necessary to determine whether Officer Rialmo violated any of the Police Department’s Rules of Conduct.

This finding does not mean that the conclusions reached by the Chief Administrator are correct and that the Superintendent’s conclusions are incorrect, but rather that the presentation of witness testimony and evidence at a hearing is necessary to determine whether there were any rule violations related to these allegations.

A copy of the written opinion will be posted on the Board’s website as required by the Municipal Code.
